Terms of Service

1. Acceptance of Terms

By using Beach Brew Request (the “App”) as a vendor or beachgoer, you agree to these Terms of Service.

2. Vendor Subscription and Usage Fees

Vendors pay a seasonal subscription fee plus a usage fee for each fulfilled request.

• The Pro Season plan ($549 for the full beach season) includes the first 1,000 fulfilled requests at no extra charge.
• After 1,000 fulfilled requests, you agree to pay $0.25 per additional fulfilled request.
• A request is considered “fulfilled” when either:
  • the customer confirms delivery by scanning the QR code on the cart, or
  • the vendor or barista manually marks the request as “Completed” in the dashboard.
• The App’s records (timestamps, QR scans, status changes, and location data) are the official and final record of fulfilled requests. You agree not to dispute or attempt to circumvent these records.

3. Payment Obligations

You authorize us to charge your saved payment method for all subscription and usage fees. Payments are due as billed (monthly or seasonally). Late payments may result in suspension or termination of access. All fees are non-refundable.

4. Accuracy and Integrity of Records

You agree not to manipulate, delete, or attempt to alter fulfillment records. Any attempt to avoid or under-report fulfilled requests is a material breach of these Terms and may result in immediate termination and legal action.

5. Data and Anonymized Reports

We may create and sell anonymized, aggregated reports based on usage data (heat maps, demand patterns, etc.). You grant us a perpetual, royalty-free license to use your order data for this purpose.

6. Privacy and Location Data

Location data is used solely to route orders and generate heat maps. See our separate Privacy Policy.

7. Termination and Suspension

We may suspend or terminate your access immediately for non-payment, breach of these Terms, or abuse of the system.

8. Limitation of Liability

The App is provided “as is.” We are not liable for lost sales, delivery delays, or any indirect or consequential damages.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey. Disputes will be resolved exclusively in the courts of Atlantic County, New Jersey.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance.
